In accordance with Article 19 of the Civil Code, citizens of our country have the right to perform any significant actions exclusively under their own name, except in cases of using a pseudonym, regulated by Article No. 166 of the Criminal Procedure Code, and legal change of name.

  • Allowed ways to change your last name
  • Problems of spouses with different surnames
  • What documents require replacement? Rules for filling out applications for change of documents

Let's look at the permitted ways to legally change your full name.

Russian passport

First of all, after marriage, you must change your passport as a citizen of the Russian Federation. This must be done within 30 days after the official registration of your marriage with the registry office. Many couples go on vacation in the coming days after the wedding, so we advise you to start changing your Russian passport immediately upon your return, without putting the matter off for a long time.

By the way, the administrative fine for living in the Russian Federation with an invalid passport for 2014 is 3000-5000 rubles for residents of Moscow and St. Petersburg and 2000-3000 rubles for all other citizens of the country. And your document becomes invalid not after 30 days, but immediately after the marriage stamp is affixed to it, if you decide to take your husband’s surname.

Where to change

The replacement of a Russian passport is carried out at the Federal Migration Service (which is also called the passport office, passport and visa service). Replacement timing:

  • 10 days from the date of submission of the application, if you applied to the FMS at your place of registration
  • up to two months from the date of submission of the application, if you applied to the FMS at the place of temporary registration or actual residence in another city

Required documents

  • An application completed by hand or typewritten, indicating a new name and a new signature. The application form can be obtained from the FMS or found on the website gosuslugi.ru.
  • Birth certificate.
  • Original marriage certificate (and other documents necessary to make notes in the new passport).
  • Receipt for payment of state duty in the amount of 200 rubles.
  • 4 photographs that meet the established requirements (35x45 mm, color or black and white).
  • Old passport of a citizen of the Russian Federation.

How to replace documents after registering a marriage

After marriage, the young wife needs to collect personal documents and go to the Federal Migration Service to receive new ones, with the surname already changed. It should be noted right away that there is no point in delaying the resolution of this issue, since the law defines certain deadlines for replacement, after which the document will not have legal force.

Let's consider which documents need to be changed after registering a marriage and changing the surname, and what can be left unchanged.

Passport

The first thing that needs to be changed after marriage is a civil passport, because it is this document that certifies a person’s identity and is the most in demand when solving various issues.

How to change your passport:

  1. Write an application for exchange on a special form.
  2. Pay the state fee and submit a receipt of payment with a personal statement.
  3. Take 4 passport photos measuring 3.5x4.5 cm.
  4. Provide the passport office employee with a marriage certificate and hand in your old civil passport for replacement.

The period for replacing a Russian passport after marriage with a change in maiden name is 1 month from the date of registration. After this period, the document loses its legal force and is considered invalid.

For untimely replacement of a civil passport after marriage with a change in personal data, a fine of 2,500 rubles is also provided.

international passport

You can also change your foreign passport at the FMS. To replace you will need some documents.

What you need to prepare:

  • personal statement on a special form in 2 copies;
  • old passport;
  • receipt of payment of state duty;
  • 4 photographs measuring 3.5x4.5 cm;
  • work book.

The young spouse will receive a new foreign passport within 1 month from the date of submission of documents. If the couple has planned a trip to another country immediately after the wedding, they can go on the trip with the wife's valid passport and marriage registration certificate. This method is suitable for traveling to visa-free countries, as well as to countries where visas are issued on arrival.

If the newlyweds are planning to spend their honeymoon in a country where entry is allowed only with an open visa, they will have to hurry up to obtain a new passport for the young wife. Special departments for issuing foreign passports provide a paid service for quickly replacing a document within 1-2 days.

The laws of the Russian Federation do not define deadlines for replacing foreign passports. This document can be changed only at personal request or if it is necessary to travel abroad.

Taxpayer Identification Number (TIN)

After marriage and a change of surname, there is no need to change the TIN, but the young spouse will still have to contact the tax office to replace the certificate of assignment of the identification number.

What documents will be required:

  • valid TIN;
  • personal statement;
  • Russian passport (original + copy);
  • marriage registration certificate.

Russian legislation does not provide for deadlines or penalties for late replacement of the TIN. A woman can use the old TIN, confirming its validity with a marriage certificate, if necessary.

International passport

Changing your international passport does not require such urgency and, by and large, its necessity remains at your discretion. If you do not plan to travel to countries in the near future that require a visa to enter, you can postpone replacing your passport. You can go on vacation to visa-free countries (Turkey, Egypt, Thailand and a number of other popular resort countries) with an old passport, the main thing is to indicate your maiden name everywhere.

Note for travelers

If you are planning to go on a honeymoon to one of the visa countries and submit documents in advance, before the wedding, then register everything in your maiden name - to obtain a visa, the surname in the Russian and foreign passports must match. After receiving a visa at the embassy, you will no longer need a Russian passport, so you will need to change it after the trip.

Where to change

You need to contact the same FMS about replacing your international passport. The replacement period should not exceed a month if you submit documents at the place of registration, and four months - at the place of stay or actual residence.

Required documents

  • An application in two copies, certified at the place of work or study, indicating the old last name, the place and time of its change, as well as all places of work/study over the past 10 years.
  • If you have a work record book, then you need a photocopy of it, certified by the HR department or immediate supervisor (if you are working) or the original (if you are not working).
  • A new Russian passport with a new surname and a photocopy of those pages on which there are inscriptions.
  • Receipt of payment of the state duty (1000 rubles for an old-style passport, 2500 for a new-style passport).
  • 4 photographs that meet the established requirements (35x45 mm).
  • Old passport.

Internet services

You can submit an application for a new foreign (as well as Russian) passport via the Internet, using the gosuslugi.ru portal. After your documents in electronic form have passed all checks, you will need to bring the originals to the FMS on a certain day and exact time, which you will be informed about. The second time you will need to come in person to pick up a new passport. This saves your time significantly; accessing via the Internet is especially convenient for people living in a different city than where they are registered.

3

Allowed ways to change your last name

According to current legislation, there are three of them:

  1. In accordance with Article 58 of the AGS (Civil Status Acts), any citizen has the right, at his own request, to change his full name upon reaching the age of 14 years. However, before reaching adulthood (18 years of age), this can only be done with the consent of both parents, except in cases where the father is unknown (there is a dash on the birth certificate), one of the parents is deprived of rights, evades parental responsibilities, or his whereabouts are unknown. Then it is enough to obtain consent from one parent;
  2. After marriage, at their own request, spouses have the right to change their surname to the surname of the husband or wife. In addition, both or one of the spouses can take a surname that consists of two parts, including the surname of both husband and wife, unless one of the spouses previously had a double surname. In the event of dissolution of the union, spouses can return the surnames that they had before the union. This right is regulated by Article 32 of the Family Code (FC of Russia). Please note that you can change your surname not at the time of marriage, but later (if necessary, an application is written to the registry office);
  3. Changing the surname of a minor by decision of the guardianship authorities to the surname of the second parent. However, this is only possible from the age of 10 and with the consent of the child himself.

According to tradition, after concluding a union, the girl takes her husband’s surname, but there are couples in which the man takes the wife’s surname.
However, in modern society, spouses are increasingly leaving their premarital surnames so as not to change the entire package of documents. This is allowed, but in addition to not having to change their passport and other official papers, these couples will face some legal complications.

Driver license

Now it is not necessary to change your license; it is enough to make a copy of the marriage certificate, certified by a notary, and take it with you in case of a meeting with traffic police officers. It is better to change the last name on your license when it expires.

Where to change

At the MREO or traffic police department at your place of residence, this procedure takes up to two months.

Required documents

  • New Russian passport
  • Marriage certificate (original and copy)
  • Medical certificate of fitness to drive a vehicle of the appropriate category with a new name
  • Driver card (issued upon receipt of your first license)
  • Receipt for payment of state duty in the amount of 800 rubles
  • Old driver's license

As for the documents for the car, there is no need to change them after marriage. It is enough just to make changes to the PTS and change the vehicle registration certificate in the traffic police.

Problems of spouses with different surnames

Difficulties for couples in which the husband and wife have different surnames begin with the birth of children. When contacting any official structure (kindergarten, school, hospital, etc.), you will have to prove that you are the parent of a child with a different last name.

In this case, you will have to constantly carry a passport with you, which has a stamp confirming your family relationship.

When contacting any official structures, a parent with a different last name will have to have the following documents with him:

  • Your birth certificate;
  • Marriage certificate with the child’s second parent;
  • Birth certificate of the baby;
  • Divorce certificate;
  • Certificate of a second or subsequent marriage (if the parent changed his last name).

Therefore, it is easier to replace the package of documents once than to face bureaucratic difficulties before the child reaches adulthood.

Bank cards and accounts

Where to change

Changing bank cards after changing your last name is mandatory to avoid confusion and “stuck” transfers. You can change your salary card through your employer; to replace the others, you will have to go to the bank. The replacement period is up to several days.

Required documents

  • Completed application
  • Copy of new Russian passport
  • Copy of marriage certificate
  • Old map

As for the bank account, it is enough to simply notify the bank about the marriage and change of surname, for which you come to the bank branch with a new Russian passport and marriage certificate. A bank employee will change your data in the database in front of you.
