How to file for divorce on weekends

In a situation where it is no longer possible to save the family, the spouses will have to resolve a number of formalities. If the decision to divorce is final, both parties are looking for a way to resolve everything as quickly, simply and without conflicts. This raises questions about where to file for divorce - in court or at the registry office, as well as on what day you can get a divorce and whether you can file for divorce on Saturday.

The answer to the question is quite simple - you can file for divorce almost any day of the week. The law provides for two options for divorce - through the court or in the registry office. It is possible to dissolve a marriage through the registry office in cases where:

  • the spouses do not have joint children under the age of majority, and they both agree to divorce;
  • one of the spouses is considered missing*;
  • one of the spouses is declared incompetent*;
  • one of the spouses was sentenced to a term of more than three years.

All other cases involve divorce through the court, and only after receiving a decision on divorce can it be registered at the registry office.

*In this case, the marriage can be dissolved without the consent of the second spouse, regardless of whether there are minor children in the family.

How many days after submitting an application to the registry office will a couple sign up?

  • We learned from our subscribers that in some registry offices, in the summer months, girls organize round-the-clock duty to get in line for a certain date. Of course, all this is unofficial and is in no way regulated by law. We would not advise you to take part in such procedures.
  • Sometimes they ask what a “civil marriage” is and whether it is necessary to submit an application to register it. According to the law, yes, such a marriage must be registered at the registry office. But in case of ordinary cohabitation or cohabitation of two people, it is not necessary to register the marriage, since no rights and obligations arise.
  • And the last point concerns the surname. Before you go to the registry office to set a wedding date and submit an application, decide what surname the bride will take. She can keep hers, take the groom's surname, or even choose a double surname.

Recently, some registry offices have allowed you to submit an application six months in advance. Very convenient for those who like to plan everything in advance. When you know the date of the celebration in advance, you can order the desired restaurant at a favorable price.

  1. The application must be submitted no earlier than 30 days before the wedding and no later than 12 months.
  2. If the bride is 7-9 months pregnant, they will get married on the day the application is submitted, but a doctor’s certificate is required.
  3. Through government services, you can submit an application even 12 months before the wedding.
  4. In 2021, the most popular dates will be 02/12/2021 and 12/21/2021.
  5. The busiest months are from May to September, so it is more difficult to guess the date these days - there may be a queue. It is best to apply for the summer months in February via the Internet.

Previously, it was necessary to draw up documents 30-60 days before marriage, now future spouses can independently choose a convenient date.

Just 7 years ago, marriage was registered only at the place of registration or registration; now this rule does not apply. The newlyweds now have the opportunity to choose any registry office or wedding palace in Russia. Someone wants to have a wedding in Moscow, and some of the newlyweds in a small village on the banks of a river.

What to do then? If registry office employees refuse to accept an application in another district or city, write a complaint addressed to the boss or go to court. Request that the refusal be made in writing, indicating the reason. The complaint is considered in 5-10 days, but the trial will drag on for 2 months.

Another important point.

Some couples apply to two or three registry offices at once because they do not know where they will live on their wedding day. This is permitted by law, but you will have to pay a state fee for each application submitted. Through public services you can submit an application only to 1 registry office.

Therefore, the first conclusion.

The application is submitted as many times as the newlyweds want, until the marriage is registered. But remember that the state fee will have to be paid every time.

Below is a list of reasons when an application will not be accepted:

  • future spouses are already in a marital relationship;
  • the bride or groom are close relatives;
  • future spouses are declared incompetent by the court;
  • The newlyweds are each other's adoptive parents and adopted children.
  • one of the newlyweds is threatened to formalize the marriage;
  • the newlyweds came drunk to the registry office;
  • one or both newlyweds are too young;

Applications are accepted at the registry office, but sometimes marriages are registered:

  • Local government bodies.
  • Consulate of the Russian Federation outside our country.
  • Authorized federal executive authorities.

Choose 1 of 4 possible options for the ceremony:

  1. Simple - newlyweds come at the appointed date and time, sign, receive a marriage certificate and stamps in their passports. It takes 5-15 minutes. Expenses go only towards state fees.
  2. Ceremonial - takes place on Saturday, music plays at the ceremony, photographers work. After registration, guests and newlyweds drink champagne and congratulate the couple. The registrar reads the vows in the ceremony hall, the spouses sign, and solemnly put rings on each other. The procedure takes 30-60 minutes. In 2021, you can officially invite a personal photographer. You need to sign up for the procedure in advance, because there are a lot of people interested.
  3. On-site - the procedure takes place outdoors, in a park or square. There is live music playing and colorful decorations all around. It takes 1 hour. Due to the high price, the service is provided by 20-30 registry offices throughout the country. A famous place is the Tsaritsyno Museum Reserve in Moscow.
  4. Combined - the marriage is registered at the registry office, as with simple registration. There will be no photographers, music, beautiful design. You can sign on Tuesday, when there is no queue. And on Saturday, the bride, groom and guests go to nature, and there they stage an off-site registration. A professional actress plays the role of a registry office registrar, vows are taken, photographers take pictures, spouses exchange rings.

Previously, witnesses were invited to the registry office to sign, but now this is not required. Only the bride and groom will be asked to sign.

Ask a Question

Question: How many months in advance must I submit an application?

The application must be submitted exactly two months in advance. True, recently many registry offices, and Palaces too, have begun to accept applications exactly one month in advance. Therefore, before you go to stand in line, call the place where you are going to apply and check the first day of application for the date you have chosen.

Question: Is it possible to sign “urgently” without waiting a month after submitting the application?

Can. To do this, at the registry office you need to explain the reason why you urgently need to get married (disrespectful reasons, like “Well, I really want to.” will not do); provide documents confirming this (for example, a pregnancy certificate).

Question: Can I apply alone?

It is possible if the groom (bride), for example, cannot be present at the registry office on the day of filing the application (he went on a business trip, got sick, was not allowed to leave work, etc.). Your actions:

  • come to the selected registry office in advance and explain the situation;
  • take the application form;
  • the groom (bride) must fill it out only with his own hand;
  • have the application certified by a notary;
  • on the day of submitting the application, you come to the registry office alone, but with a certified application from your significant other (plus your passport and receipt of payment of the state fee).

Question: Is it possible to sign at any registry office or only at the place of registration?

Recently, you can submit an application to any registry office, regardless of your place of registration.

Question: What is the amount of state duty and where can I pay it?

Currently, the state duty is 200 rubles. You can pay it at any Sberbank branch.

Question: On what days do they sign in the registry offices and palaces?

They sign in both registry offices and palaces on any day except Sunday and Monday. The only thing is that couples solemnly sign only on Friday and Saturday. Moreover, on which of these days the ceremonial registration will take place must be clarified at the registry office of your choice. Further. The last Thursday of every month is a sanitary day in registry offices, and the first Tuesday of every month in Palaces.

Question: Is a ceremony required?

The ceremony will be held only at your request. Do you want to quickly (in between times) seal your union? Yes please! Submit an application to the registry office on any weekday. On your wedding day, come at least in jeans. Sign quickly. stamp in the passport. certificate in hand. All! Free!

Question: What is “non-ceremonial registration”?

During the ceremony, you walk into the wedding hall accompanied by solemn music, a registry office employee (usually a woman) makes a congratulatory speech, and you solemnly exchange rings. All this is filmed on photo and video, with the happy faces of the guests all around...In a non-celebratory setting, everything is simpler. In the office of a registry office employee, “in a business setting,” you will be asked to sign your signatures, your passports will be stamped, and you will be issued a marriage certificate.

Question: How does the registry office differ from the Palace?

The registry offices register ALL acts of civil status: the birth of a child, marriage, divorce, and death. And the Palaces were created exclusively for marriage registration. Moreover, solemn.

This is interesting: Is it possible to challenge the privatization of an apartment in 2021 - statute of limitations, claim

Question: Is there such a service as on-site registration?

Officially, there is no registry office. You can try to negotiate such a service with the registry office staff. There are only a few reasons why registration is carried out outside the registry office. For example, in the event of a serious illness of one of the future spouses, confirmed by a medical certificate, the marriage can be registered at home or in a hospital. But now many professional wedding ceremony organizers practice on-site marriage registration. And this procedure will depend only on your imagination and financial capabilities.

Question: The application form contains a column “Last name after marriage,” but is it possible to combine both surnames (your maiden name and that of your future spouse)?

According to the law, spouses, at their own discretion, upon entering into marriage, choose the surname of one of them as a common surname, or each spouse retains their premarital surname, or, unless otherwise provided by the laws of the constituent entities of the Russian Federation, adds the surname of the other spouse to their surname. The combination of surnames is not allowed if the premarital surname of at least one of the spouses is double.

Question: Are witnesses needed?

At present, witnesses as such are not needed. They don’t appear anywhere in the registry office, they don’t sign anywhere, as was the case before. Witnesses (if you have appointed any) simply stand next to the bride and groom at the marriage registration ceremony. This is a kind of tribute to tradition.

Question: Will our photographer (videographer) be allowed to film our wedding in the wedding hall?

In registry offices and wedding palaces, one of their own videographers and one of their own photographers are allowed to film.

Question: Are there any traditions regarding the wedding procession?

According to tradition, the bride and groom go to the registry office in different cars. The bride's car goes first, but before the registry office the groom's car must overtake it so that the groom can meet the bride. After registering the marriage, the newlyweds travel in the same car. There are also traditions associated with decorating the wedding procession. The newlyweds' car is decorated with rings and flowers. All vehicles in the motorcade are decorated with colored ribbons (in our country it is customary to use ribbons in the colors of the Russian flag).

Question: How long does the walk take?

Question: How much champagne should I bring to my wedding picnic?

It's better not to take too much. The main feast is ahead of you - at the banquet. The best option is one bottle for 2-3 people. And take a few bottles of mineral water (preferably without carbon), juice or fruit drink - not everyone drinks alcohol. Refrain from sweet soda - it is far from the healthiest drink, and it will not quench your thirst.

Question: What food should I take with me?

A common option is to cut a bunch of sandwiches with sausage and cheese. Plus, take chocolates with you, because according to etiquette, champagne is eaten with chocolate.

Question: Who should I take with me on a walk?

Take young people (witnesses, friends and young relatives). Under no circumstances take your grandparents, it will be physically difficult for them. It’s also better for parents to go straight to a restaurant or, if time permits, home. Surely, they need to prepare for the meeting of the newlyweds (loaf, towel, drinking glasses, etc.).

Marriage registration at the registry office in 2021

Once the registry office registrar has checked your documents, she will look in her book to find the appropriate date and time for your wedding.

Most likely, you will be told this date orally and you will have to remember it or write it down in your notebook. But at the Wedding Palace they can give you a beautiful coupon with your last names and date when registration takes place.

In 2021, the state fee for registering a relationship is 350 rubles. If you submit documents via the Internet or government services, then pay 245 rubles (with a 30% discount).

This amount may change; details are specified in Article 333.26 of the Tax Code of the Russian Federation. Remember that only one person from the couple pays the state fee.

Note. If one of the newlyweds has a benefit, then you don’t have to pay your part of the fee. Payment is made at any branch of Sberbank. Remember that banks charge a commission of 20 rubles for this operation. After payment, bring the receipt to the registry office along with the application.

Ask the registry office employees for payment details, but most banks also have this information. If you change your mind about applying, the money will not be returned.

In addition to the application, you will be required to provide the following documents:

  1. The identification document is a passport, although in some cases a sailor's passport or military ID will do.
  2. A document authorizing persons to marry is provided if one of the future spouses has not reached the age of marriage of 18 years.
  3. A document confirming that the previous marriage has been dissolved - it is provided by citizens who were previously in a marital relationship. In most cases, a divorce certificate or death certificate of the previous spouse will suffice.
  4. If there is a foreigner in the couple, a foreign passport and translation of all documents will be required.

And one more important detail.

If you submit an application to the same registry office where your previous marriage was dissolved, then you do not need to present a certificate of dissolution.

Girls change their last name after marriage to their spouse’s last name in 60% of cases. But you can take a double surname, for example, Ivanova-Pankratova.

After the ceremony, a passport with the old surname will be valid for another 30 days. This time is given in order to have time to change all documents: passport, driver’s license, work book, tax identification number, documents for an apartment.

After the marriage is registered, the passports of both spouses will be stamped and the information will be entered into the accounting book. After some time, you will receive a marriage registration certificate.

Remember that it must be in writing. It will not be possible to come and verbally declare your intentions. Take the form from the employees who prepare the documents or download it from our website to fill out at home.

Let's take a closer look.

Remember that signatures and dates are placed at the registry office. When filling out the application, please adhere to the following rules:

  • Point 1 - indicate the first name, last name and patronymic of both spouses.
  • Column 2 - enter dates of birth and age at the time of application.
  • Point 3 - fill in the place of birth as indicated in the passport.
  • Column 4 - indicate the citizenship of the bride and groom.
  • Point 5 - indicate your nationality. This requirement is optional and can be completed as desired.
  • Column 6 - indicate your place of residence, do not confuse it with registration.
  • Column 7 - indicate your identification document. Also fill in the number, series of this document
  • paragraph 8 - fill in the information about the document that confirms the termination of the previous marriage, if you were previously married. If this is your first marriage, then mark it as missing.

Below there will be lines that are responsible for changing the last name. If the future husband or wife decides to cheat, enter the new last name in these lines. Remember that you cannot make mistakes in the application, otherwise it will be considered invalid.

The application form is divided into two halves, one part for the groom, the second for the bride, everyone must fill in the information independently. If everything is in order, they will put a special signature and stamp on the form and tell you when to come for registration.

To submit an application for marriage registration to the registry office, you will need the following documents:

  1. mandatory passports of future spouses;
  2. divorce certificate, if the bride or groom were previously married;
  3. death certificate if one of the newlyweds is a widower or widower;
  4. consent to the marriage of the parents, issued by a notary, if minors are going to marry;

How long to wait before registering a marriage after filing an application in 2020

Non-ceremonial registration involves performing only legal formalities - signing official documents, putting stamps and issuing a marriage certificate - without music, photo/video operators, crowds of guests and other surroundings. It takes place in an ordinary office, and not in a formal hall. Any form of clothing.

In most civil registry offices, non-ceremonial registrations take place on Fridays and Saturdays. At the Wedding Palace you can get married unceremoniously on any day of the week, except Sunday and Monday.

Is it possible to sign for a non-celebratory marriage immediately after submitting the application?

No. Just like in the case of ceremonial registration, you will have to wait.

Together, since both parties fill out the application. In special circumstances, you can fill out the application in advance, having it certified by a notary, but such cases are considered individually.

Do I have to wait a certain time after submitting my application? Is it possible to speed up the procedure?

According to the law, the period between filing an application and registering a marriage can be reduced (up to one day) only in the presence of special circumstances, for example: pregnancy, threat to the life of one of the parties.

In order for the newlyweds to have certainty regarding the date of the official procedure, the submitted application to the registry office must be checked strictly within the established deadlines for consideration.

How long to wait after applying to the registry office? The Family Code of the Russian Federation regulates that an application submitted to the registry office must be verified within a period of at least one month from the date of application and submission by citizens of all necessary documents.

In practice, on the day of filing an application, the civil registry office employee gives citizens the opportunity to choose the date of the official procedure with the condition that such a date is not within the one-month period for checking documents.

A similar opportunity will be provided when submitting an application through the Multifunctional Center, although the registration procedure itself can only take place at the civil registry office.

When can I submit an application to the registry office? This directly depends on the method of sending documents chosen by the newlyweds.

The fact is that it is allowed to apply not only directly to the civil registry office, but also to submit it through the Multifunctional Center. Thus, the timing of submitting an application to the registry office will depend on the working hours of the institutions.

To find out on what days an application is submitted to the registry office, just visit this institution or read the information provided on the official website.

As a rule, documentation is accepted on any working day within the working hours, so the question on what days applications are accepted at the registry office will only be related to the establishment of the work schedule of the specified body.

What days does non-celebratory registration take place?

Unlike a formal ceremony, which can be ordered online, a simple wedding can only be done in person, 5 weeks before the desired date. The moment of registration itself is scheduled for a free date. As a rule, these are days from Thursday to Sunday, one to two months after submitting the application, depending on the workload of the registry office. Under special circumstances provided by law, the period may be reduced to one or two days. Such cases include:

  • pregnancy;
  • birth of a child;
  • threat to the life of one of the parties;
  • other situations.

How long does it take to submit a marriage application to the registry office?

To apply for registration of family relationships, both future spouses must come to the registry office. Representation is not permitted, and the only exception is when one of the couple applies with a notarized power of attorney from the other. This situation often arises due to a long business trip of the newlywed, etc.

Each department has its own work schedule, so it is advisable to check the appointment time directly by phone or on the official website. In the vast majority of cases, work on accepting applications for marriage registration begins at 9.00. Today in most cities it is possible to sign up in advance and not have to wait in line.

Most branches are open until 17.30 -18.00, and are also open on Saturdays. However, one weekday in a month is a non-working day due to technical and sanitary requirements.

The waiting period for the ceremony to take place from the date of application varies significantly. This is due to the presence of a standard time allotted by law and reduced for certain categories of newlyweds.

On average, after submitting an application for marriage registration, a month passes until the celebration itself. The final period may be shorter under special circumstances. This period is given as an opportunity to prepare for the event and once again make sure that you made the right choice.

The presence of a joint minor child is another reason for an accelerated marriage registration process. To do this, the couple will need to present the child's birth certificate. In this case, the registry office employees try to reduce the waiting period as much as possible. Theoretically, registration can be immediately upon application or the next day.

Since in the standard case the period between filing an application and the ceremony is a month, many newlyweds are looking for ways to reduce it. This is possible subject to special circumstances and the presentation of supporting documents. These are often:

  • pregnancy;
  • presence of small children;
  • threat to the life of one of the future spouses;
  • urgent need to go on a long business trip;
  • actual residence of the spouses together;
  • spouse leaving for the army, etc.

Typically, registration without a festive part is more formal. The newlyweds arrive on the appointed day and time, sign the documents, and exchange rings. This takes very little time, in the standard case up to 15 minutes.

If registration takes place at the Wedding Palace, then the time spent on it is 30 minutes or more. Even more will be required for an outdoor ceremony in the European style, which includes a beautiful exit for the newlyweds, a formal registration itself, a buffet table, etc.

To begin with, it is important to say that not all people can get married. This is due to the fact that in order to legitimize the relationship, several conditions will need to be met:

  • the age of the spouses is over 18 years;
  • the bride and groom must have legal capacity;
  • the previous marriage (if any) must be dissolved;
  • To enter into a union, the consent of both partners is required.

As for the age of the spouses, in some cases it is possible to legalize the relationship upon reaching 16 years of age. However, for this there must be a good reason, for example, the bride’s pregnancy.

If all the above conditions are met, then you can proceed to study the points that are discussed before submitting an application for marriage to the registry office.

According to the Federal Law “On Civil Status Acts,” newlyweds can independently choose the place to formalize their relationship. This means that the application is submitted to any registry office located on the territory of the Russian Federation.

The choice of the registry office is not affected by permanent or temporary place of residence.

However, foreign citizens cannot apply to any registry office. There are only specific departments where relations with a citizen of another country can be registered.

As for the wedding date, you need to submit an application 30 days before the intended celebration. This is due to the fact that those getting married are given time to think about the decision.

If the couple changes their mind about legalizing their relationship within thirty days, then the application can be withdrawn without any consequences.

As a rule, an application to the registry office is submitted by two people. This is due to the fact that newlyweds will need to fill out a special form, one side of which is intended for the bride, and the other for the groom.

However, in some cases, documents are submitted by one person. Main reasons:

  1. One of the newlyweds is in prison.
  2. One of the newlyweds is outside the country or city.

The ceremony at the registry office is not mandatory. Spouses may prefer to have their marriage registered unofficially.

A simplified ceremony has several advantages:

  1. No costs. Newlyweds will only need to pay a state fee.
  2. Efficiency. Marriage registration will be completed in 15 minutes.
  3. The celebration can be held on any other day.

The current legislation of the Russian Federation establishes that the period from the moment of filing an application until the registration of marriage is one month.

A couple can legalize their relationship ahead of schedule if circumstances require it. For example, the bride's pregnancy.

There are several ways to apply for marriage registration:

  1. Contact the Civil Registry Office in person.
  2. Use the unified state portal called “State Services”.
  3. Contact the Multifunctional Center.

The most convenient option is to submit an electronic application to the Civil Registry Office through the State Services portal. To do this, you do not need to personally visit the government agency and wait your turn.

The following package of documents must be attached to the application submitted to the registry office:

  1. Valid passports of the newlyweds.
  2. A receipt confirming the fact of payment of the state fee.
  3. Papers confirming the fact of divorce (if one of the newlyweds was previously in an alliance with another entity).

It is important to understand that each case is individual, so when submitting an application to the registry office, additional documents may be required. For example, if at least one of the newlyweds has not reached the age of 18, then it is necessary to obtain permission issued by the local self-government authorities.

Filing an application and registering a marriage 2020-2021 latest important changes

From July 2021, newlyweds have the opportunity to choose their wedding day for the coming year.

In this case, the date should not be earlier than one month after submitting the application. The only exceptions are special cases, including pregnancy, childbirth, illness, etc.

The date and time depend not only on the wishes of the newlyweds, but also on the workload of the registry office. The wedding day can be rescheduled even after submitting an application.

If the date changes to a later date (but not longer than a month), it is enough to simply submit a petition about this to the registry office employees.

If the wedding needs to be postponed for more than 30 days, you must justify your desire with serious circumstances.

In Russia, not everyone can officially legitimize their relationship. So, who will not be painted in our country:

  1. Minors. This does not apply to young people who have already reached their 16th birthday, provided that the bride is pregnant or has already given birth.
  2. People who are still married. Registration will be possible only after receiving a divorce certificate, so the registry office will definitely check its authenticity, because bigamy is prohibited in our country.
  3. Incapacitated.
  4. Close relatives, as well as the adoptive parent and the adopted child.
  5. If one of the future spouses is against the union. In the Russian Federation it is registered only with the mutual consent of the two parties.
  6. Persons of the same gender.

Your application will be considered within a month and only after that the ceremony can take place. Under some circumstances, signature is possible earlier, and sometimes even on the day the document is submitted. Eg:

  • the bride is pregnant, especially in the later stages, or has already given birth;
  • one of the couple is seriously ill or is leaving on a long business trip;
  • the guy is drafted into the army.

But still, in most cases, lovers need to wait 30 days before the wedding and during this time once again weigh the pros and cons of their decision.

According to the law, people who have not reached the age of majority, but who are already 16 years old, can enter into an official marriage, under certain conditions, for example, if such a young couple is expecting a child or has already given birth to one.

Before going to the Wedding Palace, the young bride and groom should obtain individual approval from local authorities, usually issued by the head of the district administration.

For the upcoming registration you will need to bring a lot of papers, including:

  • two passports;
  • receipt of paid state duty;
  • statement;
  • written consent from the minor's parents or guardians;
  • separate permission from local authorities for each of the future newlyweds;
  • as well as certificates confirming valid reasons for painting. For example, about a girl’s pregnancy.

It happens that a Russian citizen or woman falls in love with a foreigner and wants to officially sign in Russia. This is, of course, possible, but requires the submission of additional documents. You will need:

  • passports of both lovers;
  • application completed by you;
  • receipt of payment of state duty;
  • a certificate of marital status of a foreign person, which can be obtained from the embassy or city hall. If you were previously married, then a divorce certificate;
  • visa, residence permit and migration card.

Anything can happen in life and sometimes people decide to get married, even if one of them is in prison. In this case, you will also need the entire standard set: Your passports, 2 applications, and filled out by the prisoner, must be notarized, a receipt for paid state fees, divorce paper, if you were previously married, for minors - parental consent and reason, documented.

If a prisoner is in a punishment cell, he will not be allowed to get married.

Of course, such a ceremony will be completely different from a wedding in the wild. Most likely, you will be allowed to sign only on the territory of the colony, for example, in a separate visiting room, and not in the registry office of your choice. Most often, no more than two people are allowed to be invited as guests, who must obtain special permission from an authorized person.

Often people are unfamiliar with how many days before a holiday event they need to go and submit an application to the relevant institutions. Thus, the legislation has adopted a general rule for those getting married, stating that the period from the day of filing the application to the day of registration should be one month.

This time is a “spare” time; it gives the bride and groom the opportunity to carefully weigh the decision they have made. Therefore, within 30 days after the application was submitted, the couple can refuse to marry. From the legal side, this will have absolutely no consequences.

However, it is worth noting that there are a number of situations in which registration may occur earlier or, conversely, later than the established deadline (up to 2 months). The right to make this decision rests with the head of the civil registry office.

Good reasons for registering a marriage quickly include:

  • pregnancy at any stage;
  • the birth of a common child;
  • long-term illness;
  • possible threat to life;
  • official assignment to the place of duty;
  • long work trip.

In any of the above cases, you will need to submit relevant documents confirming this or that situation. If the documents have been passed and the boss has made a positive decision, the marriage can take place on the same day the application was submitted.

Previously, the procedure for registering a marriage included filing an application 1 month before the selected date. However, as of 2021, the regulations have changed significantly. The basis was Federal Law No. 319-FZ (dated 08/03/2018) , which amended the Family Code of the Russian Federation.

Now you can choose a wedding date 1 year before the ceremony. However, the minimum period remains 1 month.

When contacting the registry office, it is important to consider the following recommendations:

  1. When submitting an application a year before the ceremony, you can choose not only the month and day, but also the time of registration. However, you will need to take into account information about available dates provided by the registry office.
  2. If it is impossible to register on the chosen day, you should try to submit an application to another registry office. It happens that in one institution the dates are scheduled several months in advance, while in another there is only one or there is no waiting list at all. If both future spouses have Russian citizenship, then they have the right to submit an application to any registry office in the country.
  3. During the summer months, civil registry office employees often extend the deadline for submitting applications. This is due to the heavy workload and queues of people wanting to get married. Statistics show that in winter the number of applicants is 3-5 times less than in summer.
  4. On special days - holidays, beautiful dates - the number of people wishing to sign also increases. And tens, even hundreds of times. The registry office employees take such days into account and try to carry out all planned ceremonies. This happens by changing the work schedule and involving all civil registry office employees in the process.

It is important to remember that the minimum period for filing an application (30 days) is required so that future spouses can once again verify the correctness of their choice. For those who have already decided everything a long time ago, this period allows them to calmly prepare for the upcoming wedding.

In the capital of the Russian Federation, the marriage procedure was initially different from the general one. Moscow residents could submit an application 6 months before the expected day of celebration. Therefore, the amendments made to the legislation did not have much impact on people registered in the capital.

At the same time, there are now 6 Wedding Palaces operating in Moscow, exclusively engaged in the registration of family unions. If there is a need to reduce or increase the scope of the regulated period, then it is recommended to contact us here. Employees of some palaces accept applications 2-3 months before the ceremony.

In addition to the adjustments already made to the rules of the marriage procedure, there are a number of proposals that are still under consideration.

We are talking about the following additions:

  • Before submitting the application and the procedure for registering the union itself, it is planned to check the spouses for debts on traffic police fines. If overdue receipts are found, the ceremony may be refused. In order to get married, you will first need to pay off all your debts.
  • Before applying to the registry office, you will need to take an HIV test.

But for now, these are just proposed amendments that have no legal force. And in general, it is not a fact that the proposals voiced will be approved in the future.

Article 11 of the Family Code describes a number of force majeure situations in which the minimum period is not taken into account. In such circumstances, the period may be reduced to 1-5 days.

Special cases are recognized:

  1. Woman's pregnancy. A couple expecting a child can be registered on the day of application. The pregnancy must be more than 2 months.
  2. Birth of a child.
  3. High risk of death of one of the partners. For example, one of the future spouses is seriously ill or is leaving for a hot spot. In the first case, on-site registration can be carried out. You won't have to pay extra for it.
  4. Long business trip. This is possible, for example, when sending a consul to another country.

Code of the Russian Federation does not contain a fixed list of reasons for immediate marriage. The decision on a specific situation always remains with the leadership of the selected registry office.
